The Harwich Conservation Commission moved to indefinitely postpone the hearing for a significant residential development at 64 Smith Street on Wednesday, as the applicant pivots toward the Zoning Board of Appeals (ZBA) to secure necessary zoning relief. The proposal, which involves the demolition of two existing barns and four sheds to make way for a townhouse building with six single-family units, has been under review since early August. Commission Staff Meg Salmon informed the board that the applicant is seeking their permits through the Zoning Board of Appeals before they come back to Conservation.

In a move aligning with the town’s recent emphasis on "gentle density" and alternative housing solutions, the Commission granted approval for a new accessory dwelling unit (ADU) and septic system at 8 Cranberry Way. Chair John Ketchum noted that the project, which recently cleared the Board of Health, serves a specific community need. It's essentially just an ADU on the existing dwelling for a home health aide to live in,
Ketchum said, noting that the plan had remained unchanged since its initial discussion in July. Vice Chair Mark Coleman agreed that the board was ready to move forward, stating, No further discussion. So, if there's a motion, we can approve this.

The meeting saw a flurry of approvals for shoreline and waterfront infrastructure, including the reconstruction of several docks and bulkheads. At 11 Nons Road, the Commission issued an Order of Conditions for dock reconstruction that includes specific environmental safeguards. Salmon explained that the proposal was pretty standard,
though the board ensured that the final permit included the shellfish mitigation that they had agreed to with the specific terms for that, and then the seasonality of this dock, which was the improvement.

Similar approvals followed for 10 Harwich Pines and 2071 Route 28. At the Route 28 property, also known as Head of the Bay Road, the work involves replacing a timber bulkhead cap, adding fill, replacing rip rap near an existing boat ramp, and managing invasive species. The Commission spent time clearing the books on two projects from the early 1990s that were never executed. At 556 Depot Street, a request was made to close out an old permit for a road that was intended to provide boat access near the intersection with North Harwich. The road was never constructed,
Salmon said, recommending a Certificate of Compliance for work never done. Ketchum recalled the site’s history, asking if it was near the former Peas Boat Works. Salmon clarified that the area is now part of the First Light property. Motion Made by J. Ketchum to issue the Certificate of Compliance for 556 Depot Street, map 45, parcel S3-8. Motion Passed 4-0. A similar situation occurred at 4 Evergreen Way, where a plan to reactivate a cranberry bog was abandoned decades ago. They never reactivated it. I believe this case was also from the early 90s,
Salmon noted, adding that the site has since naturally revegetated itself fully.

A planned discussion and possible vote on the Local Comprehensive Plan (LCP) update was delayed until the board’s next meeting on October 1. Ketchum suggested the postponement to ensure all members and lead staff could be present. I'll send that out to all of us tomorrow,
Ketchum said regarding the most recent draft, asking if changes had been flagged. Salmon confirmed that the Local Planning Committee completed the final revision in August and is currently awaiting comments. Vivienne Mulhall-Maguire supported the delay, noting that having the link sent again wouldn't do any harm, so you wouldn't have to go rooting through here
for the documents.
Finally, the Commission announced that the Select Board has approved the appointment of Susan Cyr as a new Commissioner. Cyr is expected to join the board for the October 1 meeting. I think she'll be a good addition,
Ketchum said. Mulhall-Maguire welcomed the news, adding that the board could use all the help we can get.
Before adjourning, the board also approved the minutes from their previous session. Motion Made by J. Ketchum to approve the minutes from the September 3, 2025 meeting. Motion Passed 3-0-1, with V. Mulhall-Maguire abstaining as she was absent from that session.
